Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and CarbonApps LLC ("Company," "we," "us," or "our"), governing your access to and use of the StackWho website at stackwho.com and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
StackWho is a technology intelligence platform that provides users with access to company technology stack data, decision maker contact information, industry classifications, and related search and export tools. The Service includes both free and paid subscription tiers.
3. Account Registration
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and update your information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Subscriptions and Billing
Plans. The Service offers paid subscription plans with varying levels of access to company data, contact reveals, and export capabilities. Current plan details and pricing are available on our pricing page.
Billing. Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your plan). All payments are processed through Stripe. You authorize us to charge the payment method on file for all applicable fees.
Free Trial. We may offer a free trial period for new subscribers. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
Cancellation. You may cancel your subscription at any time through your dashboard or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes. We reserve the right to modify subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service for sending unsolicited bulk email (spam) or in violation of CAN-SPAM, GDPR, or similar laws
- Harvest, scrape, or systematically download data from the Service beyond normal use of the export feature
- Resell, redistribute, or sublicense the data obtained through the Service
- Use the Service to harass, stalk, or threaten any individual or company
- Attempt to gain unauthorized access to any portion of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use automated scripts, bots, or crawlers to access the Service
- Share account credentials with third parties or use a single account for multiple users
- Use revealed contact information for purposes unrelated to legitimate business outreach
6. Data Usage and Accuracy
No Guarantee of Accuracy. While we make reasonable efforts to maintain accurate and up-to-date company technology stack data and contact information, we do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service. Technology stacks may change without notice, and contact details may become outdated.
Your Responsibility. You are solely responsible for your use of the data obtained through the Service, including compliance with all applicable laws regarding email marketing, data protection, and communications.
Data Corrections. If you believe any information in our database is inaccurate, you may submit a correction request through our contact form or by contacting us.
7. Intellectual Property
The Service, including its design, features, content, database structure, and underlying technology, is owned by CarbonApps LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.
You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Service without our prior written consent, except for data exported through authorized use of the Service's export features.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBONAPPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Indemnification
You agree to indemnify and hold harmless CarbonApps LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your use of any data obtained through the Service.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.
Upon termination, your right to use the Service will immediately cease. Any data stored in your account (saved lists, saved searches, export history) will be deleted within 30 days of termination.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
